New models of documents issued to foreigners

From 10 July 2020, new models of residence cards and permits to cross the border under local border traffic, as well as the application form for such a permit, are in force. Documents based on existing models will be issued until stocks of blank forms are exhausted, but not longer than for six months. Documents issued in accordance with the current model remain valid until the deadlines specified therein.

The following came into force on 10 July 2020:

– the ordinance of the Minister of the Interior and Administration of 7 July 2020 amending the ordinance on documents issued to foreigners (Journal of Laws, item 1218),

– the ordinance of the Minister of the Interior and Administration of 8 July 2020 amending the ordinance on the model of permit for crossing the border under local border traffic and the model of application form for granting this permit (Journal of Laws, item 1215).

Under the first of the abovementioned ordinances, Annex 1 to the ordinance of the Minister of the Interior of 29 April 2014 regarding documents issued to foreigners (Journal of Laws, item 589), which specifies the model of the residence card, has been amended.

Under the second of the abovementioned ordinances, Annex 2 to the ordinance of the Minister of the Interior of 25 April 2014 on the model of permit for crossing the border under local border traffic and the model application form for this permit (Journal of Laws, item 554) has been amended.

Both amended ordinances provide:

  1. maintaining the validity of documents issued in accordance with the models set out in existing regulations;
  2. legal basis for further issuing of residence cards and permits to cross the border under local border traffic in accordance with existing models – until stocks of blank forms of documents are exhausted, but not longer than for six months from the date of entry into force of the ordinances.

The introduction of new models was necessary to ensure the application of Regulation (EU) 2017/1954 of the European Parliament and of the Council of 25 October 2017 amending Council Regulation (EC) No 1030/2002 establishing a uniform model for residence permits issued to third-country nationals (OJ L 286, 1/11/2017, p. 9-14).
