Extension of stay in visa-free traffic

The period of residence of a foreigner on the territory of the Republic of Poland staying on the territory of the Republic of Poland on the basis of an international agreement concerning cancellation of visa requirement or towards whom partial or complete elimination of the obligation to visa requirement shall apply, can be prolonged in justified cases by further 90 days, if such a possibility is envisaged in the agreement of visa requirement cancellation. (Currently this is stipulated in the agreements with Brazil, Argentina, Chile, Honduras, Costa Rica, Nicaragua, Singapore and Uruguay).

Method of submitting the application:

A foreigner submits the application for extension of the validity period of residence pursuant to visa-free traffic personally on the territory of the Republic of Poland to the Voivode competent with regard to the place of residence of the foreigner, no later than on the last day of their legal residence on this territory pursuant to visa-free traffic, and justifies this application.

Note: extension of the validity period of residence pursuant to visa-free traffic on the territory of the Republic of Poland takes place by placing a stamp in the foreigner’s travel document confirming extension of the validity period of that stay by 90 days. Refusal to extend is exercised by means of the decision.

Necessary documents:

  1. An application drawn up in the Polish language containing data necessary to identify the foreigner (first and last name, date of birth, citizenship), address of residence, and justification.

Note: The lack of any of the aforementioned documents will result in the call of the foreigner to supplement it within the 7-days’ time limit from the delivery of the call, under pain of leaving the application without examination.

Typical documents proving the circumstances indicated in the application:

  1. Documents confirming legal residence on the territory of Poland,
  2. Photocopy of a travel document (original available for inspection).

Note: When it is necessary to explain or particularize the evidence held by the authority during the administrative proceedings, the foreigner may be called to deliver other documents or submit testimonies confirming circumstances referred to in the application.
